Parkify Privacy Policy

This Privacy Policy describes how Parkify, Inc. ("Parkify," "we," "us," or "our") collects, uses, discloses, and processes personal information through the consumer-facing Parkify website, applications, and related account and booking flows available at parkifyrec.com (the "Platform").

This Privacy Policy applies only to Parkify's consumer-facing Platform. It does not apply to separate privacy notices or practices of cities, park districts, recreation departments, or other organizations that use Parkify (each, a "Provider").

1. Parkify's Role

Parkify provides software that allows users to create accounts, browse offerings, and interact with activities, rentals, permits, memberships, registrations, and other services offered by Providers.

Depending on the context, Parkify may act in different roles:

  • Platform operations. Parkify acts directly with respect to operating the consumer Platform itself, including account creation, login, authentication, website and app functionality, security, fraud prevention, and related operational communications.
  • Provider-directed processing. For bookings, registrations, rentals, permits, waivers, uploaded documents, accommodations, and other resident-service information processed through the Platform, Parkify generally processes personal information on behalf of the applicable Provider.
  • Provider communications. If a Provider uses the Platform to send communications about its own offerings, programs, or services, Parkify generally acts as the Provider's service provider or processor for those messages.

Many Providers are public agencies. Information submitted to or maintained for a Provider may therefore be subject to public-records, records-retention, and other public-sector laws that differ from privacy laws applicable to private businesses.

2. Information We Collect

The information collected through the Platform depends on how you use it and the Provider offering involved.

Information you provide

We may collect information such as:

  • name
  • email address
  • phone number
  • mailing address
  • date of birth
  • emergency contact information
  • household and family member information
  • participant information, including age/date of birth and gender
  • waiver responses and signed waivers
  • uploaded documents
  • accommodation-related information, including disability or accessibility accommodation requests
  • permit- or rental-related documents, such as insurance certificates and similar supporting materials
  • information submitted through forms, requests, or account features

Information related to transactions and Provider services

We may collect or process:

  • bookings, registrations, reservations, rentals, memberships, permits, and waitlist activity
  • transaction and order history
  • receipts and confirmation details
  • fee, deposit, refund, and credit-related records
  • notes entered by the applicable Provider related to service delivery, such as participation preferences or accommodations

Providers should not enter highly sensitive personal information unless necessary for the safe delivery of services and permitted by applicable law.

Information collected automatically

When you use the Platform, we may automatically collect certain internet or device information, such as:

  • IP address
  • browser type
  • device type
  • operating system
  • pages or screens viewed
  • dates and times of access
  • referring URLs
  • similar usage, diagnostic, and security information

Payment information

Payments are processed by a third-party payment processor. Parkify does not collect, view, or store your full payment card or bank account information.

We may receive limited payment-related information such as transaction status, payment confirmation, payment type, or partial payment metadata needed to support the transaction.

Payment transactions may also be subject to the privacy practices, terms, and policies of the applicable third-party payment processor.

If you choose not to provide certain information required for account creation, booking, registration, permits, rentals, or other Platform features, some parts of the Platform may not be available or may not function properly.

3. How We Collect Information

We collect information:

  • directly from you
  • from your parent, guardian, household organizer, or other authorized account holder
  • from the applicable Provider
  • from service providers acting on our behalf, such as hosting, email, SMS, and payment-processing vendors
  • automatically from your device or browser when you use the Platform

A Provider may also create an account for a resident or otherwise supply information to Parkify in connection with the Provider's services.

4. How We Use Information

We use personal information for the following purposes:

  • to create, maintain, secure, and administer accounts
  • to authenticate users and enable sign-in and password recovery
  • to operate, maintain, troubleshoot, and improve the Platform
  • to process bookings, registrations, rentals, permits, memberships, waivers, uploads, and related transactions
  • to provide receipts, confirmations, reminders, account verification messages, password reset messages, and other operational communications
  • to process payments through third-party payment processors
  • to detect, investigate, prevent, and respond to fraud, abuse, security incidents, and other harmful or unlawful activity
  • to comply with legal obligations, enforce our terms, and protect the rights, safety, and property of Parkify, Providers, users, and others
  • to support the applicable Provider's administration of its offerings
  • to send Provider-related promotional or informational communications where permitted by law and directed by the applicable Provider
  • to measure Platform performance and understand usage trends if we use analytics tools in the future, consistent with this Privacy Policy and applicable law

We do not use resident personal information to market Parkify's own products or services to residents.

5. How We Disclose Information

Providers

We disclose information to the applicable Provider so it can administer its programs, rentals, permits, memberships, registrations, and services.

Service providers

We disclose information to vendors and service providers that help us operate the Platform, such as:

  • cloud hosting and infrastructure providers
  • email and SMS delivery providers
  • payment processors
  • security and fraud-prevention providers
  • analytics providers, if and when used

Legal, compliance, and safety disclosures

We may disclose information if we believe doing so is necessary to:

  • comply with applicable law, regulation, court order, subpoena, or other legal process
  • enforce our agreements or protect our operations
  • detect, prevent, or address fraud, security, or technical issues
  • protect the rights, safety, and property of Parkify, Providers, users, or others

Corporate transactions

We may disclose information in connection with an actual or proposed merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, subject to applicable legal requirements.

6. No Sale or Cross-Context Advertising Sharing

Parkify does not sell personal information.

Parkify also does not share personal information for cross-context behavioral advertising.

If our practices change in the future, we will update this Privacy Policy and provide any notices required by law.

7. Sensitive Information

Depending on how the Platform is used, we may collect or process information that could be considered sensitive in some contexts, such as:

  • date of birth
  • account login credentials
  • disability or accessibility accommodation information
  • emergency contact information
  • certain uploaded documents, waivers, or forms submitted through the Platform

We use this information only as reasonably necessary to operate the Platform, support Provider offerings, process transactions, maintain accounts, protect security and integrity, comply with law, and for other purposes permitted by applicable law.

8. Cookies and Similar Technologies

Current use

At this time, Parkify uses essential cookies and similar technologies needed to operate the Platform, such as maintaining sessions, supporting login functionality, remembering user selections, securing the Platform, and enabling basic functionality.

Future analytics tools

We may use analytics tools in the future to understand how users interact with the Platform and improve performance and usability.

If we begin using additional cookies or similar technologies that require updated disclosures or consent under applicable law, we will update this Privacy Policy and any related notices.

9. Communications

We may send communications related to your account or transactions, including:

  • account verification
  • password reset messages
  • receipts
  • booking confirmations
  • reminders
  • service or operational notices
  • SMS alerts you request or consent to receive

Providers may also use the Platform to send communications about their own offerings, where permitted by law.

You may opt out of promotional emails or texts from a Provider where an opt-out mechanism is offered, but you may still receive transactional or operational messages necessary to provide the Platform or complete a transaction.

10. Uploads and Submitted Materials

The Platform may allow you to upload documents, complete waivers, or submit forms and other materials in connection with a Provider offering.

Please provide only the information reasonably necessary for your request and avoid uploading unnecessary sensitive information.

Uploaded materials may be disclosed to the applicable Provider and processed by Parkify as necessary to support the relevant transaction or service.

11. Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • provide the Platform and support Provider offerings
  • maintain account records and transaction histories
  • comply with legal, regulatory, tax, accounting, recordkeeping, and contractual obligations
  • resolve disputes
  • enforce agreements
  • detect and prevent fraud and security incidents

Because Providers control many of the records processed through the Platform, retention periods may vary depending on the Provider's legal obligations, public-records obligations, policies, and instructions.

Even if you request deletion or close an account, we may retain certain information where required or permitted by law or where reasonably necessary for legitimate business or legal purposes.

12. Security

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, destruction, loss, alteration, disclosure, or misuse.

However, no method of internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security.

13. Children's Privacy

The Platform is not intended for children to create accounts directly.

If a Provider offering involves a participant under 18, a parent or legal guardian is expected to create the account, accept applicable terms, and provide information on the child's behalf.

14. Public Records and Provider-Controlled Information

Many Providers are public agencies or entities subject to public-records, records-retention, or similar legal obligations.

As a result, information submitted through the Platform to or on behalf of a Provider may be subject to public disclosure, retention, or other handling requirements under applicable law, subject to available exemptions and protections.

If you want to understand how a Provider handles public records, retention obligations, or Provider-controlled information, please contact the applicable Provider directly.

15. California-Specific Information

Parkify is a private company, but many Providers using the Platform are government entities. Different legal rules may apply to information controlled by a Provider than to information Parkify controls directly for operation of the consumer Platform.

If and to the extent applicable California privacy law applies to Parkify's processing of personal information that Parkify controls for the consumer Platform, California residents may have certain rights regarding that information, subject to applicable exceptions and limitations.

These rights may include, where applicable:

  • the right to request information about categories of personal information collected, sources, purposes, and categories of recipients
  • the right to request access to certain personal information
  • the right to request deletion of certain personal information
  • the right to request correction of inaccurate personal information
  • the right to non-discrimination for exercising applicable privacy rights

Requests relating to bookings, registrations, permits, rentals, waivers, resident records, or other information controlled by a Provider should generally be directed to the applicable Provider.

Parkify does not sell personal information or share personal information for cross-context behavioral advertising.

If your request relates to information controlled by a Provider, we may direct you to the applicable Provider.

We may take reasonable steps to verify your identity before responding to a privacy request.

Where permitted by law, you may designate an authorized agent to submit a request on your behalf, subject to applicable verification requirements.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version and revise the Effective Date above.

If required by law, we will provide additional notice or obtain consent for material changes.
